Public Procurement Law of Nepal is primarily regulated under Public Procurement Act 2063 (2007) and Public Procurement Rules 2064 (2007).
Public Procurement Monitoring Office facilitates and management public procurement related activities in Nepal.
Public procurement is essentially the process of a public body procuring goods, services and works from any willing and capable vendors.
Public Procurement Act requires public agencies to fulfill the procedures under the Act in order to conduct any procurement. The procedure under this Act need not be following in the following cases:
- defense related procurement;
- procurement based on procurement guidelines from a donor party in relation to donor party’s agreement with Government of Nepal;
- when a public agency requires procurement to engage in competition with private sector;
- procurement in foreign country for the purpose of social, cultural, industrial, financial, technological expositions;
- procurement in a foreign country by an embassy or consulate; and
- procurement by a public entity authorized to provide air carrier services.
The basic requirement under the Public Procurement law of Nepal is for the procuring entity to publicly ask for bids from eligible vendors. The public call should include details of the project, eligibility criteria, filing procedure, contract conditions and other relevant information. The bidders will be required to file their bids with the required information such as evidence of eligibility, price quotations and other relevant information. The procuring entity will select the best bid and proceed to execute contract.
A Bidder who is dissatisfied with the bidding process or selection may approach the concerned procuring entity or the review committee for a review of the procurement process.
Both bidding and procuring entities are required to act in accordance with the prescribed code of conduct failing which parties may be punished through blacklisting, anti-corruption action, departmental action, fines, imprisonments etc.
